EnginX – Privacy statement

EnginX values your privacy. We will therefore manage your personal data with care and comply with the privacy legislation. In this statement, we will explain to you what that means.

In a nutshell

We comply with privacy legislation. This briefly and specifically means that EnginX:

  • clearly defines the purposes for processing in advance;
  • processes only those personal data necessary for those purposes;
  • seek your prior consent where required;
  • takes the required security measures to protect your personal data;
  • also imposes these obligations on third parties processing your personal data for us; and,
  • respects your rights (such as the right to access, correct or delete your personal data).


What personal data are processed (such as stored, used and retained) for what purposes, on what basis and for how long 

When you or your organisation use our (SaaS-)services, contact us or visit our website, we process different types of personal data.

Below is indicated by purpose:

– which (categories of) personal data we process (including storage and use);

– on what legal basis (including your consent) we process that data; and,

– how long we keep that data.

Use of our (SaaS) services

If you or your organisation use our (SaaS-)services, we process the following (categories of) personal data that you provide to us (whether or not at our request), and/or are listed in:

  • the name and address of your organisation;
  • the first names or initials, surnames (optional: gender, title and position) of you, your organisation’s contact persons, as well as the persons authorised by you/your organisation to use the (SaaS-) service(s) (Users);
  • (business) telephone numbers of the aforementioned persons;
  • (business) e-mail address of the aforementioned persons;
  • correspondence with of the aforementioned persons;
  • the usernames, encrypted passwords, login details and IP addresses of Users;
  • the documents, such as agreements, relating to the (SaaS-)services; and,
  • the payment and billing details of you and/or your organisation.

We use the aforementioned data to perform (the agreement with you in relation to) our (SaaS-)services and/or our legal obligation to keep certain of your data for longer and (upon request) provide it to certain third parties.

We retain this data for as long as you use the relevant (SaaS-)service(s) and some thereof, such as invoices, we retain longer insofar as we are legally obliged to do so (example: 7 years (tax retention period).

Newsletter

If you/your organisation are/is a customer of ours – you are a Customer if you purchase one or more (SaaS) services from us – or you have signed up for our newsletter, you will receive by e-mail our newsletter with information, news and developments and we will keep you/your organisation informed, about EnginX, our (SaaS-)services and offers. For this purpose, we process the following (categories of) personal data:

  • if you are a customer:
  • the first names or initials, surnames (optional: gender, title and position) of you, your organisation’s contact persons, as well as of the Users;
  • the (business) e-mail address of the aforementioned persons;
  • If you have signed up for the newsletter:
  • your first names or initials, surnames (optional: gender, title and position);
  • your (business) e-mail address.

If you are a customer, we process the aforementioned data on the basis of our legitimate interest. If you have signed up for the newsletter, we process the aforementioned data on the basis of your consent given for this purpose.

Any person receiving our newsletter can, at any time, indicate to us via the relevant unsubscribe link in the newsletter or by e-mail to marketing@enginx.io that it no longer wishes to receive the newsletter (object c.q. withdraw consent).

Get in touch

If you/your organisation are/is a customer of ours, you have registered for it, or if you contact us, then for that and further contact (such as by phone, email, post, contact form or chat) we process the following (categories of) personal data, to the extent that you provide it to us:

  • the name and address of your organisation;
  • your first names or initials, surnames (optional: gender, title and position);
  • your (business) phone number;
  • your (business) e-mail address;
  • the information in your messages.

We use this data to manage your contact request. We keep your data for as long as it is necessary to manage your request to your satisfaction.

Customer satisfaction survey

To examine and improve the quality of our services, we sometimes conduct customer satisfaction surveys. To this end, we invite customers and/or visitors to our website to complete a questionnaire and/or for an interview. If you take part, we process the following personal data with your consent:

  • the name and address of your organisation;
  • your first names or initials, surnames (optional: gender, title and position) of you;
  • your (business) phone number;
  • your (business) e-mail address;
  • your answers.

If you agree beforehand, we sometimes also make a video recording of the interview. We use this recording for the study and keep it for a maximum of 2 months. You can withdraw your consent at any time before, during or after the recording. In that case, we will not (or no longer) use the recording and will delete it immediately.

Job applications

If you apply for a vacancy or submit an open application, we will process the (personal) data provided by you (thus with your consent) in order to be able to process your application, including your name and address, e-mail address, telephone number, motivation letter, curriculum vitae and other information you provide us during the application procedure.

To best ensure that our reputation and image are maintained, an internet and social media screening – depending on the vacancy in question – may be a necessary and justified part of the application procedure. Screening involves – based on your provided data – information about you will be searched and reviewed on internet (via internet search engines and on various social media) insofar as that information is public (accessible to anyone). We will never ask you to grant us access to secured websites, website pages, social media accounts or posts, or to connect with us. If a screening has taken place, we will notify you and – if required – discuss our findings with you. We may use the findings during job interviews and for selection purposes. Should you object to the screening, you can indicate this (preferably in your cover letter) at the time of application.

If a screening will be conducted, we do so on the basis of our legitimate interest (legal basis).

If an external HR consultant is engaged in relation to the application procedure or your application, we may forward your data to that consultant.

We use your data for the initial selection of applicants, any subsequent job interviews and possible  employment contract. Should you not be employed by us, we will retain your data for no longer than four weeks after the completion of the procedure so that we have the option to still contact you for the same or another position.

If you wish, with your prior given consent we may keep your data for up to one year to contact you in case the same or another vacancy arises. You can withdraw your consent at any time by contacting us at hr@enginx.io.

If you join us, we will keep your data in the personnel file in accordance with our internal privacy statement for our employees.

Cookies

When you visit our website, certain cookies are placed on your equipment (PC, laptop, tablet or smartphone) from us and from third parties (third-party cookies), some only being placed after your given consent thereto. These cookies collect, inter alia, your IP address, Cookie ID, application, browsing and clicking behaviour and referrer URL.

We and these third parties use these cookies to:

  • make website functionalities technically possible (technical/functional cookies);
  • analyse the use of the website and on this basis make the website more user-friendly (analytical cookies);
  • to show personalised ads (marketing cookies).

On your first visit to our website, you will see a cookie notice explaining the cookies and their purpose and, for the non-necessary ones (such as marketing cookies in any case), you will be asked your consent thereto.

reCAPTCHA

To protect our website from spam and abuse, we use Google’s reCAPTCHA service. In doing so, Google collects and analyses, among other things, a website visitor’s IP address, scrolling and movements, in order to assess whether they are a real website visitor or a robot. Provision to and processing by third parties (outside the EEA)

In order to provide our (SaaS-)services, we may provide your personal data to third parties based in or outside the European Economic Area (EEA). In case that third party processes the personal data on our behalf, we will agree the required processor agreement with that processor.

In case a third party or and processor is based outside the EEA, we will only provide and/or allow the data to be processed to that third party if there is an adequate level of protection for the processing of the personal data.

Security

To prevent unauthorised access to and use of personal data to the best of our ability, we take appropriate security measures.

Your rights

If we process personal data about you, you (as a data subject) have the following rights:

  • Access: you can request us to inform you (give you access to) what personal data of yours we process and, inter alia, for what purposes, etc.
  • Rectification: you can ask us to correct and/or complete your personal data – if it is incorrect or incomplete.
  • Withdraw consent: you can easily withdraw your given consent at any time.
  • Objection: you can object to the processing of your personal data with us.
  • Erasure: you can request us to erase your personal data.
  • Portability: you can ask us to transfer (or have it transferred) your personal data – as far as technically possible – to a third party (or have it transferred).
  • Restriction of processing: in some cases, you can request us to restrict (temporarily or otherwise) the processing your personal data.

If you wish to exercise (any of) these rights:

  • we may ask you to identify yourself. To do so, we will then request certain information from you so that we can be sure that you are the person to whom the personal data belongs.

You also have the right – if you believe your personal data are being processed in violation of (your rights  under) the privacy laws – to contact or lodge a complaint with the Personal Data Authority.
